All Private Limited Company, Public Limited Company and One Person Company at the time of incorporation through AGILE under MCA, ESI Registration would be mandatory irrespective of whether these companies are coverable under ESI Act or not.

In case, the companies registered through MCA Portal, the following actions must be taken to avoid defaulter action under ESI Act.

1. For the first six month from the date of Incorporation:
The Company need not make any compliance if it does not reach the threshold limit of ESIC.

2. For the Next six months
If the Company does not reach the threshold limit in six month, it has to login on the ESIC Website to further extend the ‘ Dormant’ mode for the further period of 180 days.
In case, it does not extend the above, the registration under ESI through AGILE will get automatically activated and the company has to start compliance/ file return under ESI Act.
If the company is found to be not complied, the necessary defaulter action under the ESI Act shall be taken against the defaulting units.

3. After Next six months
The company start compliance/ file return under ESI Act or make necessary action in this regard.
